Terms of Service

These Terms of Service govern use of promptmebetter.com (the “Store”) and the digital products and services offered through it. The Store is operated by Butiko LLC, New Mexico limited liability company, trading as Prompt Me Better, at 2201 Menaul Blvd NE, Suite A, Albuquerque, NM 87107, United States (“Prompt Me Better,” “we,” “us” or “our”).

By using the Store or placing an order, you agree to these Terms. If you purchase on behalf of a business, you confirm that you have authority to bind it. You must be at least 18 years old or the age of legal majority where you live to place an order.

1. Digital products

We sell downloadable digital content, which may include AI prompt libraries, PDF guides, prompt databases, worksheets, templates, image references, instructions and related files (“Products”). No physical item is shipped unless a product page expressly states otherwise.

The product page shown when you order identifies the selected variant, number of prompt entries, included categories, formats, language, compatibility information, licence tier and any included updates or support. Previews and sample outputs illustrate possible creative directions; they are not promises that a third-party AI system will reproduce an identical result.

2. Accounts and information

You must provide current, complete and accurate checkout and account information. You are responsible for protecting account credentials and download links and for activity carried out through them. Contact us promptly if you believe an account, payment or link has been used without authorization.

You must not use false identity, billing or business information, automate abusive requests, bypass purchase or access controls, or interfere with the Store.

3. Orders, pricing and payment

The final checkout screen displays the product, variant, price, currency, taxes and total due before payment. Prices and product availability may change prospectively. A later price change does not alter a completed purchase.

An order is accepted when payment is authorized and we issue an order confirmation or make the Product available, whichever occurs first. We may reject or cancel an order before delivery where payment is not authorized, an obvious price or description error occurred, fraud or unlawful use is reasonably suspected, supply is unlawful or the Product is unavailable. If we cancel after collecting payment and before lawful supply, we will return the amount collected.

You are responsible for taxes or charges that checkout clearly identifies as payable by you. We may use third-party payment and fraud-prevention providers, which process payment information under their own terms and privacy notices.

4. Immediate digital delivery

Products are normally supplied promptly after successful payment by the electronic access method stated in the order confirmation or a message sent to the checkout contact details; no physical shipment is made. Please review the Digital Delivery Policy for delivery methods, access, technical requirements and troubleshooting.

Where applicable law requires express consent or acknowledgement before digital supply begins during a cancellation period, we will request it separately at or before checkout and record it in the order confirmation. A general acceptance of these Terms does not replace a separate consent where the law requires one.

5. Product licence

Products are licensed, not sold. Payment does not transfer ownership of a prompt library, PDF, database, document, image reference or other source material.

Unless the product page states a different tier, the standard licence permits one named purchaser to use the prompts for lawful personal and internal commercial projects and to create final outputs for client work. Final generated outputs may be delivered to a client, subject to applicable law and the AI provider's terms, but the source Product, prompts, database and reusable files may not be given to the client.

You must not resell, redistribute, publish, sublicense, share, upload or give away a Product; provide access to unlicensed users; place it in a public or shared prompt library; translate or repackage it for distribution; use it to create a competing prompt pack or database; remove rights notices; or falsely claim ownership of the source materials. A separate team or agency licence is required where more users need source access than the purchased tier permits.

The product-specific licence and the Licence and Acceptable Use Policy provide the full usage rules. If product-specific licence terms differ from these general Terms, the product-specific terms control for that Product.

6. Third-party AI tools and generated results

Products provide creative or technical instructions for use with third-party AI tools. We do not operate or control those tools. You are responsible for obtaining any necessary account, subscription or credits and for following the provider's terms.

Results vary with the provider, model and model version, settings, inputs, reference material, prompt edits, moderation systems, regional availability and randomness. We do not guarantee:

  • an exact match to a preview or reference;
  • a specific aesthetic, technical, commercial or advertising result;
  • continuous compatibility with every AI model or platform;
  • increased sales, engagement, income or conversion;
  • that an output is unique or eligible for copyright, trademark or other protection;
  • that an output does not resemble third-party material; or
  • that an output is automatically lawful, accurate or suitable for the intended use.

You must review outputs, verify factual claims, obtain necessary permissions, conduct intellectual-property and regulatory checks appropriate to the intended use and use human oversight for consequential decisions.

7. Acceptable use

You must not use the Store or a Product to:

  • break the law or violate intellectual-property, privacy, publicity, confidentiality or contractual rights;
  • fabricate customer reviews, testimonials, endorsements, credentials, transactions or evidence;
  • impersonate a real person, create a deceptive synthetic identity or produce a harmful or non-consensual deepfake;
  • create exploitative sexual content, content involving minors, fraud, malware, harassment or unlawful discrimination;
  • mislead consumers about a product's material features or the origin of an image or claim where disclosure is required;
  • train, extract or build a competing prompt library from the Product for redistribution;
  • circumvent payment, download, usage, territorial or security controls; or
  • damage, overload, scrape or reverse engineer the Store except where a legal right cannot be restricted.

8. Reviews and submitted content

If you submit a review, image, message or other content, it must reflect a genuine experience and must not be fake, misleading, incentivized without required disclosure, unlawful or infringing. Do not include confidential information or personal information about another person without permission.

You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for the purpose for which it was submitted, such as publishing a review, operating support or promoting the Store, subject to applicable privacy and consumer law. We may moderate or remove content for a legitimate reason, but we will not suppress a genuine negative review merely because it is negative.

9. Intellectual property

The Store, Prompt Me Better branding, original text, prompt structures, databases, documents, layouts and original graphics are owned by or licensed to Butiko LLC and protected by applicable law. Third-party marks belong to their owners. No licence to use Prompt Me Better names or logos is granted except with written permission.

Unless a product page expressly grants reuse rights, product previews, model images, mockups and sample outputs are illustrative and may not be extracted or redistributed as standalone stock assets.

10. Third-party services and links

The Store is hosted by Shopify and may use independent payment, digital-delivery, email, analytics, review and support providers. Third-party products, websites and AI tools have their own terms, pricing, availability and privacy practices. We are not responsible for matters outside our reasonable control, but this clause does not exclude responsibility that mandatory law places on us.

11. Consumer rights and refunds

Nothing in these Terms excludes or limits any right or remedy that cannot legally be excluded, including rights concerning non-delivery, duplicate or unauthorized charges, corrupted files, digital content that is materially not as described or other non-conformity.

Our Refund, Cancellation and Digital Products Policy explains the normal rule for change-of-mind requests and how to report a problem. Where that policy conflicts with mandatory law, mandatory law prevails.

12. Suspension and termination

We may suspend access where we reasonably believe that an order is fraudulent or unauthorized, source files are being unlawfully distributed, a material licence breach occurred or suspension is necessary to comply with law or protect the Store. Where reasonably possible, we will notify you and provide an opportunity to resolve the issue.

If a source licence ends following an uncured material breach, you must stop using and delete the source Product. Termination does not remove rights or obligations that accrued earlier or any mandatory consumer remedy.

13. Service and warranty limits

We will supply each Product substantially as described. To the maximum extent permitted by law, the Store and Products are otherwise provided on an “as available” basis. We do not promise uninterrupted Store access, permanent third-party compatibility, exact AI output or commercial success. Mandatory warranties and guarantees remain unaffected.

Products are creative and educational resources and are not legal, medical, financial, regulatory or other professional advice.

14. Liability

Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, gross negligence where it cannot be excluded, or any other liability or remedy that applicable law prohibits us from excluding.

If you purchase as a consumer, we are responsible for reasonably foreseeable loss caused by our breach, subject to applicable law. We are not responsible for business losses arising from a purchase made wholly as a consumer.

If you purchase primarily for business purposes, and to the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, revenue, opportunity, data or reputation; and our aggregate liability arising from a Product will not exceed the amount paid for that Product. This business limitation does not apply to liability that cannot be limited.

15. Changes

The version accepted when an order is placed governs that order. We may revise these Terms prospectively when our Products, services or legal obligations change. We will change the updated date and give any further notice required by law. A revision will not retroactively reduce rights under an existing order.

16. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections available under the law that would apply without that choice. Nothing here restricts access to any court, tribunal, Consumer Arbitration Committee, regulator or consumer authority made available by mandatory law.

Please contact us first so that we can try to resolve a concern. The parties may use an agreed lawful alternative dispute-resolution method, but participation is not mandatory unless applicable law says otherwise.

17. General terms

If a provision is unlawful or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not transfer an order or source licence without our written permission, except where applicable law gives you that right. We may transfer the agreement as part of a genuine business reorganization or sale if doing so does not reduce mandatory consumer rights.

The product page, checkout disclosures, order confirmation, Terms of Sale, product-specific licence and policies referenced here form the agreement. They replace earlier statements about the same subject, but do not exclude liability for fraudulent misrepresentation or override mandatory pre-contract information.
